General Terms and Conditions - Gabriel Collezione

Article 1 – Definitions

• Consumer: natural person acting for non-commercial purposes.
• Day: calendar day.
• Digital Content: data produced and supplied in digital form.
• Distance Contract: contract concluded under a distance selling system.
• Durable Medium: a means to store information accessible for future consultation.
• Extended Duration Contract: contract for a series of products or services with obligations spread over time.
• Model Form for Withdrawal: European model form included in Appendix I.
• Outlet Products: products offered by Gabriel Collezione in the online outlet.
• Privacy Policy: privacy policy defined by Gabriel Collezione.
• Right of Withdrawal: ability to cancel a distance contract within the statutory period.
• Supplementary Agreement: products or services delivered via a third party under a distance contract.
• Technique for Distance Communication: means for communicating and concluding a contract without simultaneous presence.
• Trader: Gabriel Collezione.
• Withdrawal Period: period during which the right of withdrawal may be exercised.

Article 3 – Scope

These general terms and conditions apply to all offers and distance contracts by Gabriel Collezione.

Article 4 – The Offer

The offer contains a complete and accurate description of the products, services, or digital content and the rights and obligations of the consumer.

Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and the conditions are met. Gabriel Collezione provides all information on a durable medium.

Article 6 – Right of Withdrawal

The consumer has 14 days to exercise the right of withdrawal without giving reasons. The period starts upon receipt of the product or contract conclusion for services and digital content not supplied on a tangible medium.

Article 7 – Consumer Obligations During Withdrawal Period

The consumer must handle the product and packaging with care and only use it to assess its characteristics. They are liable only for depreciation caused by improper handling.

Article 8 – Exercising Withdrawal and Associated Costs

The consumer must notify Gabriel Collezione via the model form or clear means and return the products with accessories and packaging. Return costs are borne by the consumer unless otherwise indicated.

Article 9 – Trader Obligations in Case of Withdrawal

Gabriel Collezione refunds all payments within 14 days of receipt of the withdrawal, using the same payment method initially used.

Article 10 – Exceptions to Withdrawal

Certain products or services are not subject to withdrawal: personalized products, perishable items, sealed products for hygiene reasons, fully executed service contracts with prior agreement, etc.

Article 11 – Price

The price includes all taxes and applicable costs. Market fluctuations or public auctions may affect the final price.

Article 12 – Additional Guarantee

Gabriel Collezione guarantees the conformity of products and services with the contract. Any additional guarantee does not reduce the consumer’s statutory rights.

Article 13 – Delivery and Performance

Gabriel Collezione ensures delivery within a maximum of 30 days after order confirmation, unless otherwise agreed. Risk transfers to the consumer upon delivery.

Article 14 – Extended Duration Contracts

Consumers may terminate ongoing contracts with a maximum one-month notice. Automatic renewals are limited to certain subscriptions as specified.

Article 15 – Payment

Payments must be made within 14 days after the withdrawal period begins or the contract is concluded. Gabriel Collezione may request an advance payment up to 50%.

Article 16 – Deviations

Gabriel Collezione cannot guarantee that color, size, or text displayed online exactly matches the delivered product.

Article 17 – Privacy

Personal data provided by the consumer is processed according to Gabriel Collezione’s Privacy Policy.

Article 18 – Intellectual Property

Gabriel Collezione owns all intellectual property rights related to the products.

Article 19 – Liability

Gabriel Collezione excludes all liability for unavailable or late-delivered products, up to the purchase price of the product.

Article 20 – Force Majeure

In the event of force majeure, Gabriel Collezione may suspend obligations. If it lasts longer than two months, either party may terminate the contract without compensation.

Article 22 – Governing Law and Competent Court

These terms are governed by Moroccan law. All disputes are submitted to the competent court of Casablanca.
